This Policy does not apply to information collected offline or through other channels unless we expressly state that this Policy applies. It also does not apply to third-party websites, platforms, services, or applications that are not operated by SpeakWrite.
By using the Websites, you acknowledge that you have read this Privacy Policy. If you do not agree with our privacy practices as described in this Privacy Policy, you may choose not to use the Websites.
We may update this Privacy Policy from time to time. If we make material changes, we will provide notice as required by law.
Throughout this Policy, we refer to the term “Personal Information.” “Personal Information” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with an individual or household. Depending on the law that applies, similar terms such as “personal data” or “personally identifiable information” may be used. Personal Information does not include publicly available information, deidentified information, or aggregated information that cannot reasonably be used to identify a particular individual.
We may also collect information related to businesses, companies, institutions, or other entities rather than individuals (“Business Information”). We do not consider Business Information, such as a business name, business address, general business telephone number, professional title, employer name, business email address, business phone number, or similar business contact information, to be Personal Information except where applicable law requires otherwise.
Information We Collect or Process:
When you use or access the Websites, we may collect Personal Information directly from you, such as the following:
- Identifiers, such as first name, last name, email address, mailing address, phone number, company name, and similar contact information.
- Information you submit through online forms, including contact forms, inquiry forms, order forms, or similar website features, and the contents of any message or inquiry you submit.
- Order and transaction information, such as the services you request or purchase through the Websites, order details and order history, billing contact information, and related transaction records.
- Mobile telephone number and related information you provide if you sign up to receive text (SMS) messages from us, together with your associated consent and communication preferences.
- Account registration and login information, such as your name, email address, username, password or other login credentials, account type (customer or typist), and your account settings, activity, and preferences.
- Professional or business-related information, such as your employer, company, job title, business contact details, and information about the products, services, capabilities, or projects that may be relevant to your inquiry.
- Marketing preferences, such as whether you request to receive updates, newsletters, or other communications from us.
- Job applicant information submitted through the careers section of the Websites, such as your resume or CV, employment history, education history, professional qualifications, and any demographic information you choose to provide (for example, information requested for equal employment opportunity, diversity, or similar purposes), together with any other information you include in your application or supporting materials.
We also may collect certain information automatically when you visit the Websites, including information about the device, browser, and network that you use to access the Websites. This may include:

Cookies and Tracking Technologies
Cookies are small text files stored on a device when a user visits a website, and pixels (sometimes called web beacons) are small pieces of code that help websites recognize user activity, measure engagement, and support website functionality, analytics, and communications. On our Websites, we may use one or more of the following types of cookies or similar technologies:
- Strictly Necessary Cookies: These are used to provide the Websites, submit forms, prevent fraudulent activity, improve security, and administer the Websites. Strictly Necessary Cookies are always active because the Websites cannot function properly without them.
- Marketing Cookies (YouTube): We embed video content hosted on YouTube, a service provided by Google LLC (“Google”). When a page containing embedded YouTube content loads, YouTube may set cookies and similar technologies on your device for marketing purposes, including to measure engagement with our video content and to support the delivery of relevant content and advertising. These cookies are set by YouTube/Google as a third party, and the information they collect is processed in accordance with Google’s privacy policy, available at policies.google.com/privacy. Other than Strictly Necessary Cookies, these YouTube marketing cookies are the only cookies we use on the Websites. You can manage or decline these cookies as described in the Managing and Blocking Cookies and Your Choices sections below.

Third Party Service Providers, Marketing, and Advertising
We may use third-party technologies, plugins, integrations, and services to support the operation, security, functionality, communications, and marketing activities of the Websites. In particular, we embed video content hosted on YouTube, a service provided by Google, which may set cookies and similar technologies for marketing purposes as described in the Cookies and Tracking Technologies section above. These technologies may collect information directly from your browser or device and may use cookies, pixels, web beacons, scripts, or similar technologies. Information collected through these technologies may be processed in accordance with the applicable third party’s privacy policy, including Google’s privacy policy at policies.google.com/privacy.
We do not control third-party tracking technologies or how third parties may use information collected through such technologies. If you have questions about a third party’s practices, you should review that third party’s privacy policy or contact that provider directly. Payment Processing
If you make a payment through the Websites, your payment information is collected and processed by our third-party payment processor, BrainTree. SpeakWrite does not directly collect or store full payment card numbers or other payment credentials through the Websites. BrainTree may collect payment card information, billing details, transaction information, device information, and other information necessary to process payments, prevent fraud, and comply with applicable legal and payment card network requirements. BrainTree processes that information in accordance with its own privacy policy and applicable payment security requirements.
Managing and Blocking Cookies
Through browser settings, you can manage or block the use of cookies. In addition, you may be able to use opt-out tools for ad networks and firms who participate in the Network Advertising Initiative at optout.networkadvertising.org or the Digital Advertising Alliance at optout.aboutads.info.
To effectively manage cookies through browser settings or ad industry opt-out tools, you must set your preferences on all browsers and all devices that you use. If you clear your browser cache or cookies, you may need to reset your preferences.

Your Choices
You may choose not to provide the Personal Information we request through the Websites. However, not providing information we request may restrict your ability to use certain features of the Websites. You may also be able to restrict certain collection of Personal Information through your device or browser settings, including by disabling cookies, but doing so may prevent or impair Website functionality.
Some Internet browsers have a “do-not-track” feature that lets you tell websites that you do not want to have your online activities tracked. At this time, the Websites do not respond to browser “do-not-track” signals.
We recognize and honor opt-out preference signals, including the Global Privacy Control (GPC). GPC is a browser- or extension-based signal that communicates your privacy preferences to the websites you visit. When we detect a GPC signal from your browser or device, we treat it as a valid request to opt out of the “sale” of Personal Information, the “sharing” of Personal Information for cross-context behavioral advertising, and the processing of Personal Information for targeted advertising, in each case as those terms are defined under applicable state privacy laws and to the extent such laws apply to us. Because opt-out preference signals are tied to a specific browser or device, you must enable GPC on each browser and device you use, and if you clear your cookies or use a different browser or device, you may need to enable the signal again. How and Why We Use Your Information
We may use, disclose, transmit, transfer, store, and otherwise process the information described in the Information We Collect or Process section for various purposes, including:
- Providing, developing, maintaining, protecting, and improving the Websites and our business operations.
- Responding to your inquiries, online form submissions, requests for information, or other communications.
- Processing, fulfilling, and managing your orders, transactions, and requests submitted through the Websites, including billing, order support, customer service, and coordinating payment processing through our third-party payment processor.
- Sending you text (SMS) messages that you have requested or consented to receive, as described in the Text Messaging (SMS) section below.
- Creating, administering, authenticating, and securing customer and typist accounts, and providing account-related features, communications, and support.
- Managing and maintaining customer, prospect, supplier, and business partner relationships.
- Operating, evaluating, debugging, identifying and repairing errors, and improving our Websites, services, communications, and marketing materials.
- Understanding how visitors use the Websites, performing analytics, analyzing and reporting on Website usage and performance, and determining what content, features, capabilities, or services may interest our visitors and business customers.
- Managing advertising and marketing activities, including providing business updates, newsletters, announcements, and other communications that may interest you.
- Storing information about your preferences and recognizing you when you use the Websites.
- Creating aggregate, anonymized, or deidentified data.
- Maintaining the safety, security, and integrity of the Websites, our technology assets, our organization, and our business.
- Protecting against malicious, deceptive, fraudulent, or illegal activity, including by using security tools and anti-spam, anti-abuse, and bot-detection technologies.

We use Personal Information for the purposes described in this Policy, for purposes disclosed at or before the time of collection, and for other purposes authorized by applicable law or with your consent where required.
Our employees, advisors, contractors, and agents may access Personal Information as necessary to perform their duties and support our business operations. Access is limited to those with a legitimate business need and subject to appropriate confidentiality and security obligations.
Social Media Features and Links
The Websites may include links to our social media pages or other social media features. If you choose to interact with those features or visit a third-party social media platform through the Websites, information may be collected and processed by the applicable platform in accordance with its privacy policy and terms of use. We do not control the privacy or data-handling practices of third-party platforms and encourage you to review their policies before providing information or interacting with their services
Text Messaging (SMS)
If you provide your mobile telephone number and agree to receive text messages, we, and service providers acting on our behalf, may send you SMS or text messages, such as order or account notifications, service-related messages, responses to your requests, and, where you have separately consented, marketing or promotional messages. We send text messages only as permitted by applicable law, including the Telephone Consumer Protection Act and applicable state laws, and, where required, based on your prior express consent. Your consent to receive marketing text messages is not a condition of purchasing any goods or services.
Message frequency may vary, and message and data rates may apply depending on your mobile plan. You may opt out of text messages at any time by replying STOP to any message you receive from us, and you may reply HELP for assistance. After you opt out, we may send a single message confirming your request, and we may continue to send you non-marketing, transactional, or service-related messages as permitted by law. Mobile carriers are not liable for delayed or undelivered messages.
We do not sell or share mobile telephone numbers or SMS consent with third parties for their own marketing purposes. Information collected in connection with text messaging is used and disclosed as described in this Policy, including to the service providers that help us deliver messages on our behalf.
Online Accounts
The Websites allow you to create and log in to a personal account. We offer two types of accounts: (i) customer accounts, for individuals and businesses that use our services; and (ii) typist accounts, for the personnel who log in to perform transcription and related work. When you register for or use an account, we may collect information such as your name, email address, username, password or other login credentials, account type, and your account settings, activity, and preferences. We use this information to create and administer your account, authenticate your identity, provide account features and support, secure the Websites, and communicate with you about your account.
Typist accounts are intended for our employees and personnel. Personal Information we collect about typists and other personnel in connection with their employment or work relationship with us is addressed in the Employee and Personnel Information section below.
Employee and Personnel Information
This section applies to our employees, typists, and other personnel and job applicants (collectively, “Personnel”). In connection with recruiting, employment, and the working relationship, we may collect and process contact and identification information; government identifiers such as Social Security or taxpayer identification numbers; compensation, payroll, and bank account or payment information; professional, employment, and education history; background-check information where permitted by law; demographic information provided for equal employment opportunity or diversity purposes; and records of work performed through a typist account, such as assignments, hours, and productivity information.
We use this information to recruit, onboard, and manage Personnel; to assign and manage transcription and related work; to administer compensation, benefits, and payroll; to operate and secure our systems and accounts; to evaluate performance; and to comply with our legal, tax, and regulatory obligations. We may disclose it to service providers that support these functions, such as payroll, benefits, and background-check providers, and as otherwise described in the Disclosure of your Personal Information section below. The Security and Retention and Contact Information sections of this Policy also apply to Personnel information.
Disclosure of your Personal Information
We do not sell, rent, or lease Personal Information for monetary compensation. To the extent our use of cookies, analytics, advertising, or similar technologies is considered a “sale,” “sharing,” or use for targeted advertising under applicable privacy laws, you may opt out by using our “Do Not Sell or Share My Personal Information” link available in the footer of the Websites (which, when used, directs our consent management platform to decline non-essential cookies and similar technologies), by using any available cookie preference tool, by sending an opt-out preference signal such as the Global Privacy Control, or by contacting us using the information below. We may disclose Personal Information as described below:
- To our affiliates, subsidiaries, and operating companies for business and operational purposes.
- To third-party service providers, vendors, contractors, and business partners who help us operate, secure, host, analyze, and improve the Websites, process inquiries, manage customer or prospect relationships, coordinate payment processing through BrainTree or other payment processors, fulfill orders, deliver text messages on our behalf, and provide business, marketing, technology, or support services.

California Shine the Light Law
Pursuant to California Civil Code Section 1798.83, California residents may request and obtain from us, once per calendar year, free of charge, information about the Personal Information we shared, if any, with third parties for their direct marketing purposes in the preceding calendar year.

Children’s Information
The Websites are not directed at children. We do not knowingly collect Personal Information from anyone under the age of 16. If you are a parent or guardian and believe your child has provided us with Personal Information without your consent, please contact us using the information in the Contact Information section below, and we will take appropriate steps to remove such Personal Information from our systems.
Data Transfers
SpeakWrite is headquartered in the United States. If you access the Websites from outside the United States or provide information to us from outside the United States, your information may be collected, transferred to, stored in, or otherwise processed in the United States or other jurisdictions where we, our affiliates, our operating companies, or our service providers process information. These jurisdictions may have privacy and data protection laws that are different from those in your jurisdiction.
Where required by applicable law, we will implement appropriate safeguards for international transfers of Personal Information. By using the Websites or providing information to us, you acknowledge that your information may be transferred to and processed in the United States and other jurisdictions as described in this Policy.

The Websites are operated from the United States and are intended primarily for business users, customers, suppliers, and other visitors located in the United States. California Privacy Rights (CCPA/CPRA)
If you are a California resident, the California Consumer Privacy Act, as amended by the California Privacy Rights Act (together, the “CCPA”), gives you additional rights regarding your Personal Information. This section supplements the rest of this Policy and applies only to California residents.
